1. Thành phần hồ sơ:

– Phiếu yêu cầu xóa đăng ký (01 bản chính);

– Văn bản đồng ý xóa đăng ký biện pháp bảo đảm của bên nhận bảo đảm hoặc văn bản xác nhận giải chấp của bên nhận bảo đảm (bản chính) hoặc Văn bản xác nhận kết quả xử lý tài sản bảo đảm của cơ quan thi hành án dân sự hoặc Văn phòng thừa phát lại hoặc Bản án, quyết định của Tòa án, quyết định của Trọng tài đã có hiệu lực pháp luật về việc hủy bỏ biện pháp thế chấp, tuyên bố hợp đồng thế chấp vô hiệu; các tài liệu khác chứng minh chủ sở hữu được quyền giải chấp,…

– Giấy chứng nhận QSDĐ đối với trường hợp đăng ký biện pháp bảo dảm mà trong hồ sơ đăng ký có GCN (bản chính);

– văn bản ủy quyền (nếu có);

2. Cơ quan thực hiện:

Chi nhánh/Văn phòng đăng ký đất đai;

3. Thời hạn giải quyết:

3 ngày làm việc, kể từ ngày nhận đủ hồ sơ hợp lệ;

Lưu ý:  Nếu nhận hồ sơ sau 15 giờ, thì hoàn thành việc đăng ký và trả kết quả ngay trong ngày làm việc tiếp theo. Trường hợp phải kéo dài thời gian giải quyết hồ sơ thì cũng không quá 03 ngày làm việc kể từ ngày nhận hồ sơ đăng ký hợp lệ.

4. Lệ phí:

20.000đ/hồ sơ

5. Văn bản pháp luật áp dụng:

  • Nghị định 102/2017/NĐ-CP về đăng ký biện pháp bảo đảm;
  • Thông tư 23/2014/TT-BTNMT quy định về giấy chứng nhận quyền sử dụng đất, quyền sở hữu nhà ở và tài sản gắn liền với đất;
  • Thông tư 07/2019/TT-BTP hướng dẫn một số nội dung về đăng ký thế chấp quyền sử dụng đất, tài sản gắn liền với đất;
  • Điều 4, Thông tư 202/2016/TT-BTC quy định mức thu, nộp, quản lý, sử dụng phí trong lĩnh vực giao dịch đảm bảo.
